General terms and conditions

Definitions:

Smienk Dakwerken: The company that enters into the agreement with the customer.
Customer: The person or entity that enters into an agreement with Smienk Dakwerken.
Consumer: A customer who is an individual and acts as a private person.

Applicability:

The general terms and conditions apply to all quotations, offers, agreements, and deliveries of services and products by Smienk Dakwerken.
Deviations from these conditions can only be agreed upon explicitly and in writing.
Any additional or deviating conditions of the customer are excluded.

Quotes and Offers:

Quotations and offers are without obligation, unless stated otherwise.
They are valid for one month unless otherwise stated.
Oral acceptance must be confirmed in writing to be binding.

Prices:

All prices are in euros, including VAT and any other charges, unless stated otherwise.
Smienk Dakwerken may change prices at any time, and the customer will be informed of this in advance.
A customer has the right to cancel the agreement in the event of a price increase.

Payment and Payment Terms:

Smienk Dakwerken may require a down payment of up to 50%.
Payments must be made within 14 days of delivery.
In the event of late payment, the customer is immediately in default and interest and collection costs may be charged.
Right of withdrawal:
Consumers have a 14-day cooling-off period to cancel a purchase without giving any reason, under certain conditions.
Certain products and services are excluded from the right of withdrawal, such as custom-made products or services that have already been fully performed within the cooling-off period.
Warranty and Liability:

Smienk Dakwerken only has an obligation to make efforts and not an obligation to achieve results.
Smienk Dakwerken is only liable for damage caused by intent or deliberate recklessness, with a limit on the amount of the invoice or insurance payment.
Force majeur:

Smienk Dakwerken is not liable for shortcomings caused by force majeure, such as natural disasters, strikes, or government measures.
Amendment and Termination:

Smienk Dakwerken reserves the right to amend these terms and conditions. Major changes will be discussed with the customer in advance.
The customer has the right to terminate the agreement if Smienk Dakwerken is culpably in breach of its obligations.
Applicable Law:

All agreements are governed by Dutch law and any disputes will be submitted to the Dutch courts.
